Welcome to IndiePhoenix! These terms and conditions outline the rules and regulations for the use of our platform.

1. The Platform

IndiePhoenix (“the platform”, “we”, “us”) provides a marketplace venue for users (“buyers” and “sellers”) to connect with each other. We are a neutral facilitator and not a party to any agreement or transaction between users.

2. Limitation of Liability: We Are Just a Venue

This is the most important part. Please read it carefully.

• No Responsibility: IndiePhoenix is not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, safety, morality, or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items, or the ability of buyers to pay for items.
• No Endorsement: We do not pre-screen users or the content or information provided by users. We cannot ensure that a buyer or seller will actually complete a transaction.
• Release: You hereby release IndiePhoenix, its owners, employees, and agents from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with disputes between you and one or more other users. You are responsible for your own interactions and transactions.

3. User Responsibilities

• You are responsible for your own conduct and for ensuring that your listings, communications, and transactions comply with all applicable laws.
• You agree not to use the platform for any illegal or unauthorized purpose.

4. Governing Law

These terms will be governed by and interpreted in accordance with the laws of Germany, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Germany for the resolution of any disputes.

5. Changes to These Terms

We reserve the right to modify these terms at any time. We will notify you of changes by posting the updated terms on this site. Your continued use of the platform after such changes constitutes your acceptance of the new terms.
